Retrospective 2002: Enforcement of PACE Resolutions

I. Protest rallies staged by opposition in early 2002 resulted in a hearing of the Council of Europe specialized structures on the situation in the Republic of Moldova.
ADEPT comment: As a follow-up to the PACE resolutions, Moldovan authorities undertook several measures, among others adopted several legal acts:
- On July 26, 2002 Parliament passed the Law on National Public Audiovisual Institution, "Teleradio-Moldova" Company. Later on several draft laws on amending the said law have been developed. Furthermore, by the end of the year the Parliament received Council of Europe expert advice on the issue.
- On June 21, 2002 Parliament passed the Law on modification and completion of legal acts regulating deputy status and mandate withdrawal. Later on Council of Europe experts commented that the amendments operated are not enough and that Parliament should exclude in general the provisions of MP mandate withdrawal.
- On July 26, 2002 Parliament adopted the Law on modification and completion of the Parliament Regulation and Law on Government. The law provides for the procedure of initiating and conducting public debates on the drafts developed by the Government and Parliament. In 2003 several draft laws were published in mass media, however representatives of civil society weren't too active in providing a feedback.
Besides the said legal acts, Republic of Moldova authorities were called to submit for the Council of Europe expertise draft laws on functioning of democratic institutions, local public administration, law enforcement forces, freedom of press, etc.
