Important: According to the Election Code (par.(7) art.39), at the beginning of the electoral period, the diplomatic and consular missions update and make public the available voter rolls. An updating of voter rolls ends 7 days before the Election Day.
Article 38. The Right of Voting and Being Elected
(1) The foundation of State power is the will of the people made known through free elections held at regular intervals and based on universal, equal, direct, and free suffrage.
(2) Except for the persons banned from voting by law, all the citizens of the Republic of Moldova having attained the age of 18 on or by the voting day inclusively have the right to vote.
(3) The right of being elected is granted to all citizens of the Republic of Moldova enjoying the right of voting.
Article 39. The Right of Administering
(1) The citizens of the Republic of Moldova have the right of participating in the administration of public affairs, either directly or through their representatives.
(2) The access to a public office or position is guaranteed by law to all citizens of the Republic of Moldova.
Article 2. Principles of Participation in Elections
(3) Citizens of the Republic of Moldova residing outside of the country shall enjoy full voting rights under this Code. Representatives of diplomatic and consular missions shall be obliged to create conditions for the citizens to exercise freely their electoral rights.
Article 29. Establishment of Precincts and Precinct Electoral Bureaus
(13) At diplomatic missions and consulates, a chairperson and secretary of the precinct bureau shall be elected. At diplomatic missions and consulates with less than three workers, voting shall be done by diplomatic mail, in which case the ballots must be sent to the Central Electoral Commission by Election Day.
(14) To ensure the exercise of the constitutional right to vote, the Central Electoral Commission may form precincts and precinct electoral bureaus in other instances as well.
Article 39. Voter Rolls
(7) Voter rolls for electoral precincts constituted outside the Republic of Moldova shall be compiled on the basis of data collected by heads of diplomatic missions and consular offices who operate on the soil of the respective countries.
At the beginning of the electoral period, the diplomatic and consular missions inform update and make public the available voter rolls. An updating of voter rolls end 7 days before the Election Day. The updated voter rolls are immediately sent to Central Electoral Commission.
Article 49. Preparation of Ballot-Papers
(3) Printed ballots shall be stored by the responsible district electoral council and delivered to precinct electoral bureaus on the eve of elections based on an act of delivery.
Central Electoral Commission sends the ballot papers to the precinct electoral bureaus established abroad at least 3 days before the Election Day, based upon the (reported) number of voters registered in the updated voter rolls with a supplement of maximum 5%.
Article 50. Time and Place of Voting
Voting is carried out on Election Day between (7:00 and 21:00). The precinct electoral bureau shall publicly announce the time and place of voting no later than 10 days before Election Day.
